Terms of Service

1. Definitions

• “Golden Hour Digital,” “we,” “us,” or “our” refers to Golden Hour Digital, a DBA of Summers Digital LLC.
• “Services” refers to web development, design, maintenance, and related digital services.
• “Client,” “you,” or “your” refers to any individual or organization engaging our Services.
• “Deliverables” refers to the websites, code, designs, and other materials created for you.

2. Services

Golden Hour Digital provides web development and digital services including:

• Custom website design and development
• Web application development
• Website maintenance and support
• Content management system setup and training
• Search engine optimization (SEO)

3. Client Responsibilities

To ensure successful project completion, you agree to:

• Provide accurate and complete information, content, and materials in a timely manner
• Respond to requests for feedback and approvals within reasonable timeframes
• Designate a single point of contact for project communication
• Ensure you have the legal right to use all content you provide
• Pay invoices according to agreed-upon terms

5. Intellectual Property

• Upon Final Payment: You own the completed website design and custom code created for your project.
• Our Retention: We retain ownership of pre-existing code and frameworks, and the right to display your project in our portfolio.

6. Revisions

Project scopes include a specified number of revision rounds. Additional revisions beyond the original agreement will be billed at our standard hourly rate ($75/hour).

7. Warranty

We provide a 30-day warranty following project launch. During this period, we will fix bugs resulting from our work at no charge. This does not cover issues caused by your modifications, third-party plugins, or hosting problems.

Both parties agree to keep confidential any proprietary information shared during the project, including business information, login credentials, and pricing.

10. Termination

Either party may terminate with written notice. Upon termination, you are responsible for payment of all work completed. Deposits are non-refundable. You will receive completed work for which payment has been received.

11. Indemnification

You agree to indemnify and hold harmless Golden Hour Digital from any claims arising from content you provide, your use of the Deliverables, or your breach of these Terms.

12. Governing Law

These Terms shall be governed by the laws of the Commonwealth of Pennsylvania. Any disputes shall be resolved in Pennsylvania courts.

13. Modifications

We may update these Terms from time to time. Changes will be posted on our website with an updated date. Continued engagement of our services constitutes acceptance of modified Terms.
